Alec Baldwin wept as a judge threw out manslaughter charges in an incident on the set of ‘Rust’. His lawyers said that the prosecutors hid the evidence.
‘The late discovery of this evidence at trial prevented its effective use in a way that affected the fundamental fairness of the trial,’ Judge Mary Marlo Sommer said in part explaining her decision to dismiss the case.
Baldwin’s attorney, Luke Nikas, asked for the case against his client to be dismissed, saying prosecutors relied on evidence that would help shed light on how the pellet gun ended up on the set of ‘Rust.’
Baldwin accidentally shot and killed cameraman Galina Hutchins and injured director Joel Souza during a rehearsal for one of the scenes.
Baldwin claimed that he did not pull the trigger of the gun and does not know why it contained live ammunition.
